Re: Your Letter to EPA Regional Administrator Robert Varney dated June 16, 2008

Housatonic Remediation Project, Corrective Measure Study for Rest-of-River

Dear Mr. Secretary:

BioGenesis writes to concur with your letter of June 16, 2008 to Robert Varney of EPA Region 1 requesting additional time for GE to respond back to EPA regarding the pending comments on the CMS. In particular, we agree with your statement “Any decision on the extent and method of the cleanup must be grounded in a thorough assessment of the advantages and disadvantages of all viable approaches.”

We believe that additional time should be taken to consider the potential of emerging technologies, such as the BioGenesisK Sediment Washing Process, for the remediation of the Housatonic River. We strongly support the concept of pilot projects as part of overall planning for a site remediation that will extend for many years. Accordingly we enclose a copy of our recent letter to the Western Regional Office of the Massachusetts Department of Environmental Protection in which we provide a response to their previous comments as well as a standing offer from the BioGenesis Management Team to visit Massachusetts to make a technical presentation about our technology and recent accomplishments.

BioGenesis firmly believes that the Housatonic Rest of River project presents a significant opportunity for the Commonwealth of Massachusetts to set an example of advanced thinking by using a modern approach to solving difficult environmental problems, and to do so in full partnership with other governmental bodies, industry, and the public. We look forward working with GE and all of the local, state, and federal agencies to create a nation leading approach to the restoration of such a valuable natural resource as the Housatonic River.

Sincerely,

Charles L. Wilde

Executive Vice President

Commonwealth of Massachusetts letter to EPA Region 1 dated June 16, 2008.

Massachusetts Secretary for Energy and Environmental Affairs requests deferral of decision on GE's Corrective Measures Study in view of need for additional coordination between all stakeholders, and the potential for legal action and delays if stakeholder consensus is not achieved prior to the EPA decision.
